Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter referred to as the “Terms”) govern the mutual rights, obligations, and conditions for the purchase of goods between the Buyer (hereinafter referred to as the “Buyer”) and MB “OLIVA”, company code 307627147 (hereinafter referred to as the “Seller”) in the online store.

1. GENERAL PROVISIONS 1.1. By placing an order, the Buyer confirms that they have read these Terms and agree to comply with them. 1.2. The Seller reserves the right to change these Terms at any time. Amendments apply to new orders. 1.3. The online store is intended for the purchase of consumer goods.

3. CONCLUSION OF THE PURCHASE-SALE AGREEMENT 3.1. The purchase-sale agreement is considered concluded from the moment the Buyer places the order, pays for it, and receives confirmation by email. 3.2. The Seller has the right to refuse to fulfill an order if:

  • Incorrect data has been provided;
  • It is not possible to fulfill the order;
  • There are suspicions of abuse or fraud.

4. PRICES AND PAYMENT 4.1. All prices are indicated in euros and include VAT (if applicable). 4.2. Payments are processed using the UAB “Paysera LT” payment system. 4.3. The Buyer pays for the goods in advance, unless otherwise specified.

5. DELIVERY 5.1. Goods are delivered to the address specified by the Buyer or to the selected parcel locker. 5.2. Delivery times are indicated for each order or communicated individually. 5.3. The Seller is not liable for delays caused by couriers or other third parties.

6. WITHDRAWAL FROM THE AGREEMENT AND RETURNS 6.1. The Buyer has the right to withdraw from the agreement within 14 calendar days from the date of receiving the goods, except in cases provided by law. 6.2. The returned goods must be unused, undamaged, and in their original packaging. 6.3. The Buyer covers the costs of return, except in the case of defective goods. 6.4. Refunds are issued within 5 business days from the date the goods are received.

7. DEFECTIVE GOODS 7.1. Defective or non-conforming goods shall be replaced, repaired, or refunded. 7.2. The provisions of the Civil Code of the Republic of Lithuania shall apply.

8. LIABILITY 8.1. The Buyer is responsible for the accuracy of the information provided. 8.2. The Seller is not liable for losses arising due to incorrect information provided by the Buyer. 8.3. The Seller is not liable for indirect losses.

9. PERSONAL DATA 9.1. Personal data is processed in accordance with the Privacy Policy. 9.2. Data processing is carried out through the Shopify infrastructure and associated service providers.

10. INTELLECTUAL PROPERTY 10.1. All content of the website (texts, design, images, etc.) belongs to the Seller or is lawfully used. 10.2. Copying or distributing any content without written consent is prohibited.

11. FORCE MAJEURE 11.1. The parties shall not be liable for failure to perform their obligations due to circumstances of force majeure.

12. DISPUTE RESOLUTION 12.1. Disputes shall be resolved through negotiation. 12.2. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania. 12.3. The Buyer may also contact consumer rights protection institutions.

13. FINAL PROVISIONS 13.1. If any part of these Terms becomes invalid, the remaining provisions shall continue to apply. 13.2. These Terms apply to all purchases made on the website.
